Terms of Service

These Terms are the agreement between you and Better Form LLC for the Form app. Please read section 4 on health and safety even if you read nothing else. By downloading or using Form, you accept these Terms; if you do not accept them, do not use the app.

1. Who we are

Form is a workout app for iPhone and Apple Watch, published by Better Form LLC, the company responsible for it. In these Terms, we, us, and our mean Better Form LLC, and you means the person who downloads or uses the app.

These Terms cover the Form app on every device you use it on, along with the Form widgets, the Apple Watch app, and the website at trainwithform.com. They do not cover Apple's own services, such as the App Store, iCloud, or Apple Health, which are governed by Apple's terms.

2. Your license to use Form

Better Form LLC grants you a personal, non-exclusive, non-transferable, revocable license to use Form on Apple devices you own or control, in accordance with Apple's Licensed Application End User License Agreement and the App Store Terms of Service. Form is licensed to you, not sold. Better Form LLC keeps all rights not expressly granted here.

This license lets you install and use the app for your own personal training. It does not let you rent, lease, lend, sell, sublicense, or redistribute the app, and it does not transfer any ownership of the app or its content to you.

3. Eligibility

You must be at least 13 years old to use Form, and old enough in your jurisdiction to agree to these Terms. If you are under the age of majority where you live, a parent or guardian must agree to them on your behalf.

By using Form you confirm that you meet these requirements and that you are able to enter into a binding agreement. If you agree on behalf of a child or another person in your care, you are responsible for how they use the app and for making sure exercise is appropriate for them.

4. Health and safety

Form is a fitness tool, not a medical service. Better Form LLC is not a healthcare provider, and nothing in the app is medical advice, diagnosis, or treatment. The exercise instructions, videos, muscle information, and any suggested workout are general information, not a prescription written for your body. Consult a physician before beginning any exercise program, particularly if you are pregnant, recovering from injury or surgery, or living with a heart, joint, or other medical condition.

Stop immediately and seek medical attention if you feel pain, dizziness, or shortness of breath. Exercise carries an inherent risk of serious injury or death. You use Form voluntarily and you assume that risk. You are responsible for your own form, your own loads, and your own judgment about what is safe for you on a given day.

5. Free features and Premium

Browsing the exercise library, building and running workouts, and logging sets are free. Premium unlocks the additional surfaces described on the upgrade screen in the app. Which features sit behind Premium may change as the app develops. We will not remove a feature you have already paid for during a subscription period you have already purchased.

Premium is an optional subscription. Form has no accounts, so access to Premium comes from your Apple Account and is restored through Apple on any device signed in to it. If you reinstall the app or move to a new device, the restore option on the upgrade screen asks Apple to confirm your subscription.

6. Subscriptions, billing, and cancellation

Premium is offered as Premium Yearly at $100 per year, in U.S. dollars. Prices in other storefronts are set by Apple's price matrix and may differ. Subscriptions are auto-renewable. Payment is charged to your Apple Account at confirmation of purchase, and the subscription renews automatically for the same period unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.

You can manage or cancel a subscription in your Apple Account settings. Canceling stops future renewals; the subscription remains active for the rest of the period you have already paid for. Premium is enabled for Family Sharing. One subscription covers every member of your Apple Family group, and the organizer is the person billed. If prices change, Apple's rules govern how and when the change reaches existing subscribers, including when your explicit consent is required before a renewal at a higher price.

7. Refunds

All purchases are made through Apple, and Apple handles all refunds under its own policies. Better Form LLC cannot issue a refund for an App Store purchase. Request one through Apple, and write to support@trainwithform.com if we can help.

If you cancel a subscription, you keep Premium until the end of the period you have paid for, and no partial refund is issued for the unused time unless Apple decides otherwise. If you believe you were charged in error, contact Apple first, because only Apple can see and reverse the charge.

8. Your data and your suggestions

Your workout data is yours. It lives on your device, we never receive it, and we make no claim to it. See our Privacy Policy. If you send us a suggestion, idea, or feedback, you grant Better Form LLC a perpetual, worldwide, royalty-free, irrevocable license to use it in any way, including building it into the app, with no obligation to compensate or credit you. Do not send us anything confidential or anything you do not have the right to share.

Because your data stays on your devices and in your own iCloud, you are responsible for keeping it safe. We cannot recover workouts that are lost when a device is erased, when the app is deleted, or when iCloud data is removed, and we cannot move your data between Apple Accounts for you.

9. Acceptable use

Do not copy, extract, scrape, or redistribute the exercise database, the instructional videos, or any other content in the app. Do not reverse-engineer, decompile, or attempt to derive the source code of the app, except to the extent that restriction is unenforceable under applicable law. Do not circumvent, disable, or interfere with the subscription entitlement or any security feature. Do not use Form for any unlawful purpose, or to build or train a competing product or dataset.

These limits protect the exercise library, which is the core of the app, and the people who use it. Breaking them is a material breach of these Terms, and we may end your license under section 15 and pursue any other remedy the law allows. If you are unsure whether something is permitted, write to support@trainwithform.com before you do it.

10. Intellectual property

Form, the Form name and logo, the exercise database, the instructional videos, the artwork, and the design of the app are owned by Better Form LLC and protected by copyright, trademark, and other laws. These Terms grant you no right to use our marks.

Apple, iPhone, Apple Watch, App Store, and iCloud are trademarks of Apple Inc. Other names and marks that appear in the app belong to their owners. Their appearance does not mean those owners endorse Form, and nothing in these Terms gives you a right to use them.

11. Availability and changes to the app

We may add, change, or remove features, and we may release updates or stop supporting older versions of the app, older versions of iOS and watchOS, or older devices. We do not promise that the app will be uninterrupted or error-free.

Form runs on your device and does not depend on a Better Form LLC server. Some parts rely on Apple services, such as the App Store for purchases, iCloud for sync, and Apple Maps for route maps, and those parts are unavailable whenever the Apple service or your internet connection is.

12. Disclaimer of warranties

The app is provided as is and as available, without warranty of any kind, whether express, implied, or statutory, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the exercise information is complete or correct for your circumstances, or that using the app will produce any particular result. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.

Figures the app shows, such as distance, pace, speed, and elevation on a tracked route, are estimates calculated from your device's sensors and may be inaccurate. Do not rely on them for medical, safety, or navigation decisions.

13. Limitation of liability

To the fullest extent permitted by law, Better Form LLC is not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of the app.

To the fullest extent permitted by law, our total liability for all claims relating to the app is limited to the greater of the amount you paid Better Form LLC through the app in the twelve months before the claim, or one hundred U.S. dollars.

Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for gross negligence, fraud, or personal injury caused by our willful misconduct. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

14. Indemnification

You agree to indemnify and hold Better Form LLC harmless from any claim, loss, or expense, including reasonable attorneys' fees, arising out of your misuse of the app, your violation of these Terms, or your violation of any law or third-party right.

This section applies to the fullest extent the law allows. It does not limit any other right or remedy we have under these Terms or under the law, and it continues to apply after you stop using the app, as section 15 provides.

15. Termination

These Terms apply for as long as you use Form. You may end them at any time by deleting the app. We may suspend or end your license if you materially breach these Terms. Sections 8 through 14 and 17 survive termination.

When these Terms end, your license to use the app ends with them. Ending the Terms does not delete anything. Your data stays on your device and in your iCloud until you remove it, and an active subscription keeps renewing until you cancel it in your Apple Account settings.

16. Apple

Apple is not a party to these Terms and has no responsibility for the app or its content. Better Form LLC, not Apple, is solely responsible for the app, for any maintenance and support, and for any claim that the app infringes intellectual property rights or fails to conform to legal requirements.

If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

17. Changes to these Terms

If these Terms change, the revised version is posted at trainwithform.com/terms-of-service with a new effective date at the top. Continuing to use Form after a change means you accept the revised Terms.

Form has no accounts and holds no email address for you, so we cannot notify you of a change directly. Check the effective date from time to time. If you do not agree with a revised version, stop using the app and cancel any subscription before it renews.

18. Governing law and venue

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the app will be brought exclusively in the state or federal courts located in California, and you consent to the personal jurisdiction of those courts.

Nothing in this section takes away consumer protections that the law of the place where you live gives you and that cannot be waived by agreement. Where such a law applies, it controls to the extent it conflicts with this section.

19. Severability and entire agreement

If any provision of these Terms is held unenforceable, the rest remains in force and the unenforceable provision is modified only as far as needed to make it enforceable. These Terms, together with our Privacy Policy, are the entire agreement between you and Better Form LLC regarding the app.

If we do not enforce a part of these Terms, that is not a waiver of our right to enforce it later. You may not transfer your rights under these Terms to anyone else. We may transfer ours to a successor that takes over the app. Section headings are for convenience and do not change the meaning of the text.
